Under federal law, you cannot legally possess a handgun, pistol or rifle if you have been convicted of domestic violence or a felony. A key defense in many weapons cases is how police came in contact with you. If your vehicle was pulled over, did police have a legal right to do so? Did the police have probable cause to search you or your vehicle? If not, the gun evidence can be suppressed.

Misdemeanor Gun Charges

The misdemeanor charge of carrying a concealed weapon usually follows a search after a traffic stop. If the officer finds a gun under the seat or in the center console, that is charged as carrying a concealed weapon.

If this is a first offense, I am often able to negotiate a reduction in charges or dismissal. If the charges are dismissed, I can also seek to have the arrest expunged (or cleared) so you will not be tagged with a criminal record.
