Concealed Weapon and Felon in Possession in State and Federal Court
Weapon and gun charges can be some of the most serious charges within our legal system, especially if you are a felon in possession or you were charged with a gun crime in connection with a drug arrest.

Federal Gun Charges
Under federal law, you cannot legally possess a handgun, pistol or rifle if you have been convicted of domestic violence or a felony. If you are arrested on this charge, you can be prosecuted in federal court and face serious prison time. A key defense in many weapons cases is how police came in contact with you. If your vehicle was pulled over, did police have a legal right to do so? Did the police have probable cause to search you or your vehicle? If not, the gun evidence can be suppressed.
Misdemeanor Gun Charges
The misdemeanor charge of carrying a concealed weapon usually follows a search after a traffic stop. If the officer finds a gun under the seat or in the center console, that is charged as carrying a concealed weapon.
If this is a first offense, I am often able to negotiate a reduction in charges or dismissal. If the charges are dismissed, I can also seek to have the arrest expunged (or cleared) so you will not be tagged with a criminal record.
